TERMS AND CONDITIONS OF USE AdvantageCare Physicians offers patients personalized and secure on-line access to portions of their medical record. The Web-based version of our electronic medical record is called myACPNY. It enables you to securely use the Internet to help manage and receive information about your health:

View test results
Request prescription renewals
Access trusted health information resources
Communicate electronically and securely with your medical care team.

myACPNY does not reflect the complete contents of your medical record. To use myACPNY, you must accept these Terms and Conditions by clicking "I Accept" below.

We reserve the right at our sole discretion to revoke your access to myACPNY at any time for any reason. AdvantageCare Physicians also reserve the right to discontinue providing myACPNY access altogether.

For your privacy, your myACPNY session will terminate automatically after 15 minutes of inactivity and you will have to log into your account to continue using the system. Response to Electronic Communication AdvantageCare Physicians will make its best effort to provide a timely response to electronic inquiries. In some cases, the clinical staff that needs to respond to an electronic inquiry or other communication may not be immediately available so a patient should allow at least two (2) business days for a response. Accordingly, emergency situations requiring immediate attention should not be submitted electronically, instead, call 911 or go to your nearest emergency room. Furthermore, with respect to any electronic commun ications sent by the patient, we are only able to respond to such communications based on the information provided by the patient. If there is insufficient information provided, we will be unable to provide an accurate and reliable response. Web Site Links myACPNY may offer links to related medical web sites not managed by AdvantageCare Physicians. These web site links are for informational purposes only. AdvantageCare Physicians does not endorse and has not verified the accuracy of the information on these web sites, and the patient should not rely on any of the information found on these web sites for purposes of treatment or diagnosis. AdvantageCare Physicians shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content products or services available on or through such third party websites or applications. Adult Eligibility Any adult age 18 or over is eligible for a myACPNY account. Minor Eligibility Parents or guardians of minor children age 0 to 11 (inclusive), may request proxy access to their child's account by following the terms outlined in the Proxy Access - Adult to Child section of this Terms and Conditions. Minor children between the ages of 12 and 17 (inclusive) will be eligible to participate in myACPNY. Children in this age range will have the same access as adult eligibility. Proxy Access - Adult to Adult Adult patients may grant proxy access to their Adult Proxy. Such access does not expire, and shall remain active until the proxy access is revoked by either the adult patient from within their Physicians reserves the right to revoke proxy access at any time for any reason. Proxy Access - Adult to Child Parents or guardians of minor children, age 0 to 11 (inclusive), may request proxy access to the child's myACPNY account. Such access will only be granted to parties with parental rights or legal guardianship over the myACPNY account holder. myACPNY account will be activated for both the proxy and the child patient. The proxy will access the child’s health information through the proxy account. If the proxy's legal relationship with the account holder changes, the proxy must inform the clinic immediately by contacting their provider of care. Due to limitations currently imposed by State and Federal law, when a minor patient reaches age 12, their myACPNY account shall be deactivated, along with all proxy access to the account. Parents or guardians of children age 12 to 17 (inclusive) may only be granted proxy access to the child's myACPNY account by the child signing a Proxy Access Consent Form. Proxy access consent will need to be renewed every two years. Proxy access will be restricted to comply with the limitations currently imposed by State and Federal law. Proxy access will be terminated when the child reaches 18 years of age. Proxy Access - Legal Representatives Legal representatives shall be given Proxy Access to information for patients who are incapacitated, have an intellectual disability, or may otherwise be unable to act on their own behalf. The legal representative shall present to AdvantageCare the court order or other official document confirming his/her status as legal representative of the patient. AdvantageCare Physicians reserve the right to revoke proxy access at any time for any reason. E-mail Privacy Patients who are users of myACPNY should be aware that they will be notified via e-mail when there is new medical information to be viewed on myACPNY. This means that any person with access to a patient's e-mail will be able to see this notification. This could include the patient's spouse, employer or anyone else that can access a patient's e-mail account. Although no private health information will be sent by e-mail notification, the notification that new health information is available by accessing myACPNY may be information that a patient would not want others to know. Thus, patients should take this into account when providing an e-mail address. Please know that if you send us an e-mail communication, it may be shared with the AdvantageCare Physicians’ staff that assists the physician in providing the patient's medical care. A patient's confidential health information on myACPNY will be accessible only to appropriate staff. Security and Confidentiality We afford the same degree of confidentiality to medical information stored on myACPNY as is given to medical information stored by AdvantageCare Physicians in any other medium. AdvantageCare Physicians is committed to protecting the confidentiality of your medical information. We limit AdvantageCare Physicians personnel's access and ability to enter or view information based upon their role in your care. Firewalls, passwords, encryption, and audit trails are further used to safeguard your information. We shall identify the records released and note the time and date of access each time a patient accesses myACPNY. We have taken steps to make all information received from our online visitors as secure as possible against unauthorized access and use. It is your responsibility to select a confidential password, to maintain that password in a secure manner, not to share the password, and to change the password if you believe it may have been compromised in any way. Content Usage You are prohibited from violating or attempting to violate the security of the myACPNY and from using the program to violate the security of other websites by any method, including, without limitation: (a) accessing data not intended for you; (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measurers without proper authorization; (c) attempting to interfere with service to any user of the program, host or network, including, without limitation, via means of submitting a virus to the program, overloading, "flooding", "spamming", "mailbombing" or "crashing"; (d) sending unsolicited e-mail, including promotions and/or advertising of products or services; or (e) forging any AdvantageCare Physicians or Program packet header or any part of the header information. Violations of system or network security may result in civil or criminal liability. LIMITATION OF LIABILITY; DISCLAIMER OF WARRANTIES ADVANTAGECARE PHYSICIANS PROVIDES myACPNY "AS IS" WITH ALL FAULTS AND MAKES NO WARRANTIES OR GUARANTEES OF ANY KIND, AND EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES OF ANY KIND OR NATURE, WHETHER EXPRESS, IMPLIED, OR STATUTORY REGARDING myACPNY. INCLUDING BUT NOT LIMITED TO THE ACCURACY, COMPLETENESS, CORRECTNESS, TIMELINESS OR USEFULNESS OF ANY INFORMATION, PROGRAMS, PRODUCTS, SERVICES, OR OTHER MATERIAL PROVIDED THROUGH myACPNY, OR OF RELIABILITY, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ADVANTAGECARE PHYSICIANS MAKES NO REPRESENTATION, WARRANTY OR GUARANTEE THAT YOUR ACCESS TO myACPNY WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR FREE, OR FREE OF VIRUSES OR OTHER HARMFUL ELEMENTS, AND SUCH WARRANTIES ARE EXPRESSLY DISCLAIMED. YOU AGREE THAT IN NO EVENT WILL ADVANTAGECARE PHYSICIANS AND ITS EMPLOYEES, CONTRACTORS, VOLUNTEERS, AND AGENTS BE LIABLE TO YOU, ANYONE CLAIMING BY, THROUGH OR UNDER YOU, OR ANYONE ELSE FOR (i) ANY DECISION OR ACTION TAKEN, OR NOT TAKEN, IN RELIANCE UPON THE INFORMATION CONTAINED OR PROVIDED THROUGH myACPNY; (ii) CLAIMS ARISING OUT OF OR RELATED TO myACPNY; (iii) YOUR USE OF myACPNY; (iv) USE OF DISCLOSURE OF YOUR PERSONAL OR MEDICAL INFORMATION THROUGH USE OF myACPNY; OR (v) FOR ANY INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, POSSIBLE HEALTH SIDE EFFECTS, LOSS OF REVENUES, PROFITS OR SAVINGS AS A RESULT OF myACPNY, EVEN IF ADVANTAGECARE PHYSICIANS KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES, CLAIMS, DEMANDS, OR ACTIONS. GOVERNING LAW myACPNY may only be accessed from the United States of America. THIS USER AGREEMENT, AND YOUR USE AND ACCESS OF myACPNY IS GOVERNED BY THE LAWS OF THE STATE OF NEW YORK, WITHOUT REGARD TO ITS CONFLICT OF LAWS RULES. JURISDICTION AND VENUE FOR ANY CAUSE OF ACTION ARISING UNDER THIS AGREEMENT SHALL BE IN NEW YORK COUNTY, NEW YORK. Confirmation I understand that myACPNY is not for emergency use. In the case of an emergency, I will call 911 or contact my medical provider directly. I understand that it is my responsibility to select and maintain a confidential secure password, and to change my password if I believe it may have been compromised in any way.
